Legal Requirements & The MOT Test

Since February 2014 the inspection of the exhaust system carried out during the MOT test includes a check for the presence of a DPF. A missing DPF, where one was fitted when the vehicle was built, will result in an MOT failure. A vehicle might still pass the MOT visible smoke emissions test, which is primarily intended to identify vehicles that are in a very poor state of repair, whilst emitting illegal and harmful levels of fine exhaust particulate.

It is an offence under the Road vehicles (construction and use) regulations (Regulation 61a(3)) to use a vehicle that has been modified in such a way that it no longer complies with the air pollutant emissions standards it was designed to meet. Removal of a DPF will almost invariably contravene these requirements, making the vehicle illegal for road use. The potential penalties for failing to comply with Regulation 61a are fines of up to £1,000 for a car or £2,500 for a light goods vehicle.

With the ever changing MOT emission requirements changing and getting stricter on the diesel vehicle output of emissions, it’s imperative the DPF vehicle stays on the vehicle and performs as the manufacturer intended.

Deliberately removing a Diesel Particulate Filter is seen by some drivers (and companies offering this service) as a more cost-effective way of running their vehicle, when this should of course be down to more compatible driving habits to suit diesel vehicles. Removing a DPF is also seen as a cheaper option than buying a new DPF – while this is true in the short-term, the long-term costs of removing a DPF could be huge.

In short, it’s illegal – since 2014, it has been an MOT failure, and in 2018, the MOT test became much more stringent. The MOT DPF check has been flawed – it relies on a visual check only, and it can be difficult to tell if a DPF has been removed just by looking.

Why risk driving an illegal vehicle with a removed DPF when there is a much cheaper option than replacing the DPF.
